Solar installer slapped with permanent ban following criminal conviction

The Clean Energy Regulator (CER) has permanently suspended the operations of a solar installation company, following a criminal conviction in Perth Magistrates Court. 

In a statement issued on Friday, the CER said it has suspended the registration of Tanway Engineering Pty Ltd under the Renewable Energy (Electricity) Act 2000 (the Act), meaning it can no longer create STCs.

The CER said it had also determined that Tanway Engineering failed to meet its responsibilities and obligations as a registered agent under the Act. The company’s suspension is permanent.

Accredited installer, Rohit Jafal, also received a reprimand from the CER, but only had his license taken away for up to three months. 

During this period, Jafal will be unable to carry out any installations under the Small-scale Renewable Energy Scheme (SRES) and any that are carried out, won’t be eligible for small-scale technology certificates (STCs).

The suspension follows the two parties’ respective criminal convictions in the Perth Magistrates Court.

Jafal pled guilty to submitting electrical safety certificates for solar installations without holding the required electrical contractor licence, and instead using the license of Tanway Engineering.

As Tanway Engineering allowed for the misuse of its licence, the Court found the company to have facilitated the crime. Both parties also received fines for their action.

Another solar installer received a similar ban last year for also falsifying electrical safety certificates.
